Meeting of Creditors

341 Hearing

infographic: 341 hearing

The meeting of creditors, is also called a 341 hearing. It is called a 341 hearing because the hearing is required by section 341 of the Bankruptcy Code.  The 341 hearing is where you meet with the bankruptcy trustee in your bankruptcy case. The hearing gives your creditors an opportunity to be heard.  Though creditors are able to attend the 341 hearing, rarely do these creditors ever attend.
Creditors may attend your meeting of creditors, although often none will appear. At the hearing, the bankruptcy trustee will ask you a series of questions. Most 341 hearings last less than 5 or 10 minutes.  Your bankruptcy attorney will run through things with you prior to the hearing.  At Chapter Bankruptcy Law, we make sure that you are represented at your 341 hearing and will be with you every step of the way as you proceed down the road to financial freedom through filing for bankruptcy protection in Arizona.
Things to remember when answering questions at your 341 hearing:
  • Always tell the truth
  • The Trustee does not represent you.  Keep your answers as short & concise as possible and do not offer any information unless specifically asked. Remember you are being recorded at your 341 hearing!
  • An Arizona bankruptcy lawyer from our law firm will be with you at the meeting.
  • If, at the meeting of creditors, you believe you will have a problem answering one of these questions truthfully, please ask to speak privately to your lawyer off of the record.
